3. Subscription and Billing

Our services are offered on a monthly subscription basis. By subscribing, you authorize us to charge your payment method on a recurring monthly basis at the rate corresponding to your selected plan.

Prices are subject to change with 30 days' written notice. You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. No refunds are provided for partial months.

4. Client Responsibilities

You agree to:

• Provide accurate and complete information necessary for us to perform our services
• Ensure that all content you provide (text, images, logos) does not infringe on any third-party intellectual property rights
• Respond to requests for information or approvals in a timely manner
• Maintain the confidentiality of any account credentials we provide

5. Intellectual Property

Upon full payment, you own the content you provide to us (text, images, logos). We retain ownership of our proprietary code, templates, design systems, and tools used to build your website.

We reserve the right to display your completed website in our portfolio and marketing materials unless you notify us otherwise in writing.

6. Website Hosting and Uptime

We strive to maintain 99.9% uptime for all hosted websites. However, we do not guarantee uninterrupted service and are not liable for downtime caused by factors outside our control, including but not limited to third-party hosting provider outages, internet connectivity issues, or force majeure events.

7. Edits and Revisions

Each plan includes a specified number of revision rounds as described on our pricing page. Additional revisions beyond what is included in your plan may be subject to additional fees, which will be communicated to you in advance.

8. Limitation of Liability

To the fullest extent permitted by law, Simple Instant Sites shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, or business opportunities, arising out of or related to your use of our services.

Our total liability for any claim arising from these terms or our services shall not exceed the total amount you paid to us in the 12 months preceding the claim.

9. Termination

Either party may terminate this agreement at any time with written notice. Upon termination, we will cease hosting your website at the end of the current billing period. We can provide an export of your website content upon request.

We reserve the right to suspend or terminate services immediately if you violate these terms or use our services for unlawful purposes.

10. Disclaimer of Warranties

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Governing Law

These terms shall be governed by and construed in accordance with the laws of the state in which Simple Instant Sites operates, without regard to its conflict of law provisions.

12. Changes to These Terms

We reserve the right to update these Terms of Service at any time. We will notify you of material changes by posting the updated terms on our website with a revised "Last updated" date. Your continued use of our services after such changes constitutes acceptance of the updated terms.
